FunGen licence

FunGen is not open-source. It is free of charge for personal, noncommercial use, under the PolyForm Strict License 1.0.0 together with the FunGen Supplemental Terms. Both apply. The full text of each is below.

This summary is not the licence and does not replace it. It is here so you do not have to read the legal text to know where you stand.

FunGen is free for personal, noncommercial use. No pass needed for the editor and the free trackers.
Nobody may sell, resell, or charge for FunGen. Not in any form, not under any licence, not ever. There is no licence you can buy that grants the right to resell FunGen, and there never will be.
FunGen may not be redistributed. No mirrors, re-uploads, repackagings, published forks, ports, or modified builds. Point people at the official download instead.
The funscripts you author or edit yourself are yours. Use them, publish them, share them, sell them. We claim no ownership and take no cut.
Selling scripts made with the Pro AI features needs a commercial licence. Sharing them with the community for free does not, and never will. Letting the AI do the work and then charging for the result is a commercial use of FunGen.
A Pro Pass covers one person, on the machines that person owns. It is non-transferable: do not share it, publish it, or resell it. Leaked or forged passes get blocked.
No warranty. The software is provided as is.

## Acceptance

In order to get any license under these terms, you must agree to them as both strict obligations and conditions to all your licenses.

## Copyright License

The licensor grants you a copyright license for the software to do everything you might do with the software that would otherwise infringe the licensor's copyright in it for any permitted purpose, other than distributing the software or making changes or new works based on the software.

## Patent License

The licensor grants you a patent license for the software that covers patent claims the licensor can license, or becomes able to license, that you would infringe by using the software.

## Noncommercial Purposes

Any noncommercial purpose is a permitted purpose.

## Personal Uses

Personal use for research, experiment, and testing for the benefit of public knowledge, personal study, private entertainment, hobby projects, amateur pursuits, or religious observance, without any anticipated commercial application, is use for a permitted purpose.

## Noncommercial Organizations

Use by any charitable organization, educational institution, public research organization, public safety or health organization, environmental protection organization, or government institution is use for a permitted purpose regardless of the source of funding or obligations resulting from the funding.

## Fair Use

You may have "fair use" rights for the software under the law. These terms do not limit them.

## No Other Rights

These terms do not allow you to sublicense or transfer any of your licenses to anyone else, or prevent the licensor from granting licenses to anyone else.  These terms do not imply any other licenses.

## Patent Defense

If you make any written claim that the software infringes or contributes to infringement of any patent, your patent license for the software granted under these terms ends immediately. If your company makes such a claim, your patent license ends immediately for work on behalf of your company.

## Violations

The first time you are notified in writing that you have violated any of these terms, or done anything with the software not covered by your licenses, your licenses can nonetheless continue if you come into full compliance with these terms, and take practical steps to correct past violations, within 32 days of receiving notice.  Otherwise, all your licenses end immediately.

## No Liability

***As far as the law allows, the software comes as is, without any warranty or condition, and the licensor will not be liable to you for any damages arising out of these terms or the use or nature of the software, under any kind of legal claim.***

## Definitions

The **licensor** is the individual or entity offering these terms, and the **software** is the software the licensor makes available under these terms.

**You** refers to the individual or entity agreeing to these terms.

**Your company** is any legal entity, sole proprietorship, or other kind of organization that you work for, plus all organizations that have control over, are under the control of, or are under common control with that organization.  **Control** means ownership of substantially all the assets of an entity, or the power to direct its management and policies by vote, contract, or otherwise.  Control can be direct or indirect.

**Your licenses** are all the licenses granted to you for the software under these terms.

**Use** means anything you do with the software requiring one of your licenses.

2. FunGen Supplemental Terms

What an off-the-shelf licence cannot cover: the Pro Pass, the AI models, and who owns the funscripts you make.

These Supplemental Terms apply **in addition to** the PolyForm Strict
License 1.0.0 in the accompanying `LICENSE` file. Together they are the
FunGen licence. Where these terms are stricter, these terms apply; nothing
here grants you rights that PolyForm Strict does not.

They cover what an off-the-shelf licence cannot: the Pro Pass, the AI
models, and who owns the funscripts you make.

Definitions used below: **FunGen** or the **Software** is the FunGen
application in any form - source, binaries, installers, app bundles, and
everything shipped with or downloaded by it, including the machine-learning
model weights, encrypted or otherwise. **Pro AI Features** are the features
unlocked by a Pro Pass that generate or modify funscript data automatically:
the AI/ML trackers, AI suggestions, and batch generation.

## 1. Pro Pass

A Pro Pass (`.fgpass`) unlocks paid features. It is a personal, revocable
entitlement to use those features. It is **not** a sale of the Software or
of any copy of it, and it grants no right to distribute anything.

- A Pro Pass is issued to **one person**, and is for that person's use only.
  You may install it on the machines **you personally own or control** - for
  example your desktop and your laptop. It is not a site, team, household,
  or organisation licence.
- A Pro Pass is **non-transferable**. You may not share, publish, lend,
  resell, or otherwise pass on a Pro Pass file or its contents, and you may
  not let anyone else use the Software through your pass.
- Pro Passes that are shared, published, leaked, forged, or used to
  circumvent these terms **may be blocked** in current and future builds,
  without notice and without refund.
- A time-limited Pro Pass unlocks paid features for its stated term only.
  Nothing obliges the licensor to issue, renew, replace, or keep honouring
  a Pro Pass beyond that term.

## 2. No circumvention

You may not:

- circumvent, disable, bypass, or interfere with any licensing, entitlement,
  metering, or protection mechanism in the Software;
- decrypt, extract, convert, retrain on, or repackage the Software's
  machine-learning model weights, or make them usable outside the Software;
- reverse-engineer the Software in order to do any of the above; or
- create, use, publish, or distribute any patch, crack, keygen, forged Pro
  Pass, loader, or instructions for producing one.

Obtain FunGen only from the official channels. Do not re-upload or mirror it
(PolyForm Strict already forbids distributing the Software; this is a
reminder, not a new restriction).

## 3. The funscripts you make

This is the part most users care about, so it is stated plainly.

**Scripts you author or edit yourself are yours.** Funscripts you create by
hand in FunGen's editor, or that you have made your own through your own
editing work, belong to you. The licensor claims no ownership of them and no
royalty on them. You may use, publish, share, and **sell** them freely.

**Selling scripts made with the Pro AI Features needs a commercial licence.**
If you use the Pro AI Features to generate a funscript, or to assist you in
authoring one, and you then sell that script or otherwise monetise it, that
is a commercial use of FunGen and requires a Commercial Licence (section 4).
Letting the AI do the work and then charging for the result is exactly what
the noncommercial licence does not cover.

**Sharing AI-generated scripts for free is fine.** Publishing scripts made
with the Pro AI Features to the community, at no charge and with no
commercial benefit to you, is a noncommercial purpose and is permitted.

## 4. Commercial Licence

Any commercial use of FunGen - including selling scripts produced with the
Pro AI Features, use by or on behalf of a business, and use in a paid
production pipeline - requires a separate written Commercial Licence from
the licensor.

A Commercial Licence covers only the seats it names. It never permits
selling, reselling, sublicensing, or redistributing FunGen itself: no
licence of any kind does, and none ever will.

## 5. Third-party components

FunGen incorporates third-party open-source components, each under its own
licence. Those licences govern those components, and nothing in the FunGen
licence limits your rights under them. See the accompanying
`THIRD-PARTY-NOTICES` file for the list and the required attributions.

## 6. No warranty, no liability

The disclaimer in the PolyForm Strict License 1.0.0 ("No Liability") applies
to these Supplemental Terms in full. The Software is provided as is, without
warranty or condition of any kind.

Nothing in the FunGen licence excludes or limits any liability that cannot
lawfully be excluded or limited, or affects the statutory rights you have as
a consumer.

## 7. Changes

The licensor may publish revised Supplemental Terms for future versions of
the Software. The version shipped with a given build governs that build. The
